The US “Safe Harbor” Scheme – EU legislation prohibits the export of protected data (other than to EU members and Switzerland) because other countries are deemed to have inadequate data protection legislation. In particular this prohibition applies to the USA where emphasis is placed on freedom of information rather than its protection. To overcome this problem the US Department of Commerce has established a “Safe Harbor” scheme under which companies may apply for approval of their Data Protection Policies which, if granted, enables them to receive protected data from the EU.
